PERFORMANCE AGREEMENT

(Personnel Numerology/Astrology and/or Handwriting Analysis)

The undersigned parties, hereinafter referred to as “Client” and S. A. Petullo Corporation (“SAPC”) understand and agree as follows:

The undersigned “Client” hereby requests “SAPC” to produce personnel analyses under the following terms and conditions:

1. “Client” shall furnish “SAPC” with handwriting specimens (see requirements “how to prepare a handwriting sample”) and/or birth data, and information regarding purpose of analysis, within ethical limitations, safeguarding the third party from harm.

2. “Client” and “SAPC” herein agree that the fee to be charged for the analysis described above (see “analysis options” on “S. A. Petullo Rates and Services" form) shall be paid before or upon receipt of analysis, unless other arrangements are made in writing, prior to performance of the work.

3. “Client” and “SAPC” understand and agree that all information which shall be contained in the herein-referred to analysis shall be solely the evaluations and opinions of “SAPC” based on the writing specimens, and/or birth data submitted. It is further agreed between “Client” and “SAPC” that the contents of said analysis shall be kept confidential and only made available to supervisory personnel who have a “need to know.” Every effort must be made by authorized officers of “Client” requesting an evaluation to supervise the transmission of the sample and/or birth data to “SAPC.” The findings of “SAPC” are qualified and subject to verification by examination of the original handwriting sample when an inadequate sample, photocopy or fax copy is submitted for evaluation. No changes of any kind are to be made to any analysis if it is to be distributed to the person whose birth data and/or handwriting was analyzed.

4. “Client” hereby agrees to accept full responsibility for any resultant claims which may arise from declarations made in said analysis, and shall indemnify and hold “SAPC” harmless from any and all such claims.

5. “Client” hereby agrees to avoid basing hiring or other decisions solely on the results of the “SAPC” analysis.
